Associated Terminals of St. Bernard LLC seeks more than $3 million for damages

NEW ORLEANS – The operator of the Chalmette Midstream Buoys alleges damages after a crane failed.

Associated Terminals of St. Bernard LLC filed a complaint on May 22 in the U.S. District Court for the Eastern District of Louisiana against Potential Shipping HK Co. LTD and M/V Unison Power alleging negligence.

According to the complaint, the plaintiff alleges that on May 19, the M/V Unison Power was moored at defendant's Midstream Buoys in order to discharge a cargo, when a fixed crane failed, causing damage the plaintiff's spreader bar, coaming ladder, the barge ESV-101B and to the cargo itself. The plaintiff alleges it sustained property and economic damages. 

The plaintiff holds Potential Shipping HK Co. LTD and M/V Unison Power responsible because the defendants allegedly failed to properly inspect and maintain the vessel’s crane and/or its cables and failed to employ competent and/or attentive crane operator.

The plaintiff requests a trial by jury and seeks award in a sum estimated to be no less than $3,100,900, with interest, costs, attorneys’ fees, and expenses and such other and further relief as may be just and equitable. It is represented by Patrick J. McShane, T. Patrick O’Leary, Danica C. Benbow and Katie P. Rice of Frilot LLC in New Orleans.
