B&L Transportation Inc. alleges buses have defective brakes, engines

NEW ORLEANS – A Larose company claims it purchased defective school buses and has been damaged.

B&L Transportation Inc. filed a complaint on May 23 in the U.S. District Court for the Eastern District of Louisiana against Navistar Inc., Navistar International Corp. and IC Bus LLC alleging that they violated the federal Racketeer and Corrupt Organizations Act.

According to the complaint, the plaintiff alleges that, between 2004 and 2015, plaintiff purchased several school buses manufactured and sold by defendants. It alleges that the buses came equipped with defective diesel engines and defective brake systems.

As a result of defendants' allegedly unlawful acts, plaintiff alleges it has suffered economic damages for expending substantial amount for the costs of repair and replacement parts and for the downtime while waiting for repairs and/or replacement parts. The plaintiff holds Navistar Inc., Navistar International Corp. and IC Bus LLC responsible because the defendants allegedly intentionally and fraudulently sold their buses with defective engines and brake systems.

The plaintiff seeks compensatory, punitive and treble damages, attorney’s fees, costs and all additional relief that the court deems fair and equitable. It is represented by Anthony Irpino, Louise C. Higgins and Kacie F. Gray of Irpino, Avin & Hawkins Law Firm in New Orleans.
