Woman claims she fell from walkway of New Orleans apartment due to faulty railing

NEW ORLEANS – A woman is seeking damages for a fall from the second story of her New Orleans apartment.

Ciara Nichole Joye filed a lawsuit June 1 against Pamela Fortner, Earl Benhardt and Wilshire Insurance Co. in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff was going to her apartment at 905 Orleans Ave. on May 6 when the incident took place. The suit states that the plaintiff fell when she leaned on the railing of the second-floor hallway. The plaintiff fell to the courtyard and was seriously injured as a result of the fall, the complaint states.

The defendants are accused of negligence by failing to repair the railing or warn of the danger and overall negligence of management.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Nicholas J. Muscarello in Hammond.

The case has been assigned to Division G Judge Robin M. Giarrusso.
