NEW ORLEANS – A boat owner has filed a suit against two individuals and an insurance company seeking damages after an incident on the Barataria Waterway near Lafitte.

Laurence P. Favalora filed a complaint on June 2 in the U.S. District Court for the Eastern District of Louisiana against Kevin Jennings, Matt Wall and State Farm Fire and Casualty alleging that they violated the Louisiana insurance law.

According to the complaint, the plaintiff alleges that on June 4, 2016, he and a passenger sustained personal injuries and physical damages to the plaintiff's boat and appurtenances when Jennings, operating a boat owned by Wall, drove his boat up and over the rear of the plaintiff's boat. The suit states that State Farm was provided with a list of property damages and medical expenses, but misrepresented the facts regarding its insurance coverages to the plaintiff.

The plaintiff holds Jennings, Wall and State Farm Fire and Casualty responsible because the plaintiff claims that State Farm is responsible to pay all of the damages sustained to him and refused to accept his offer to settle his claims. He alleges he is entitled to recover all unpaid damages from the defendants.

The plaintiff seeks to recover all of his damages from defendants, plus interest, costs and all other relief as equity and justice may require. He is represented by Dean A. Sutherland of Dean A. Sutherland Law Office in New Orleans.
