Dauphine Orleans Hotel guest files suit after he fell after stepping out of door

NEW ORLEANS – A California man claims he was injured at a French Quarter hotel because of an inappropriate design of a door.

Kevin Phetteplace filed a complaint on June 2 in the U.S. District Court for the Eastern District of Louisiana against 415 Rue Dauphine LLC, Interstate Hotels & Resorts Inc., Generation Holdings LLC and Liberty Mutual Insurance Co. alleging negligence.

According to the complaint, the plaintiff alleges that on April 6, 2017, he was a guest at defendants' Dauphine Orleans Hotel. The suit states he opened a door that he believed was the bathroom in his room and as he took a step, he fell over a railing and plummeted to the ground. He alleges he sustained serious and permanent injuries that required extensive surgery. The plaintiff holds 415 Rue Dauphine LLC, Interstate Hotels & Resorts Inc., Generation Holdings LLC and Liberty Mutual Insurance Co. responsible because the defendants allegedly failed to have proper and sufficient locks to secure the subject door, which was inappropriately designed and installed.

The plaintiff requests a trial by jury and seeks judgment against the defendants in such amounts reasonable in the premises and costs and expenses of this litigation. He is represented by Michael R. Allweiss and Abigail F. Gerrity of Lowe, Stein, Hoffman, Allweiss & Hauver LLP in New Orleans.
