John W. Stone Oil Distributor alleges facility was damaged by vessels

NEW ORLEANS – The Terrytown owners of an oil storage facility in Gretna alleges it was damaged because of the actions of two tugboats and a barge.

John W. Stone Oil Distributor LLC filed a complaint on June 9 in the U.S. District Court for the Eastern District of Louisiana against Kirby Corp., Penn Maritime Inc., Bisso Towboat Co. Inc., M/V Lucia, Barge Caribbean and M/V William S alleging negligence.

According to the complaint, the plaintiff alleges that as a result of the allision caused by defendant's negligence on Jan. 15, 2016, the plaintiff sustained losses. The plaintiff holds Kirby Corp., Penn Maritime Inc., Bisso Towboat Co. Inc., M/V Lucia, Barge Caribbean and M/V William S responsible because tugboat Williams allegedly lost control of ATB Lucia/Caribbean resulting in allision with plaintiff's oil transfer and storage facility and several tank barges moored at said facility.

The plaintiff seeks an order for the arrest of M/V William S and ATB Lucia/Caribbean, payment for losses sustained by plaintiff, plus interest and all further relief as the law and justice may grant. Haas III of Pugh, Accardo, Haas, Radecker & Carey LLC in New Orleans.
