NEW ORLEANS – The Terrytown owners of an oil storage facility in Gretna alleges it was damaged because of the actions of two tugboats and a barge.

John W. Stone Oil Distributor LLC filed a complaint on June 9 in the U.S. District Court for the Eastern District of Louisiana against Kirby Corp., Penn Maritime Inc., Bisso Towboat Co. Inc., M/V Lucia, Barge Caribbean and M/V William S alleging negligence.

According to the complaint, the plaintiff alleges that as a result of the allision caused by defendant's negligence on Jan. 15, 2016, the plaintiff sustained losses. The plaintiff holds Kirby Corp., Penn Maritime Inc., Bisso Towboat Co. Inc., M/V Lucia, Barge Caribbean and M/V William S responsible because tugboat Williams allegedly lost control of ATB Lucia/Caribbean resulting in allision with plaintiff's oil transfer and storage facility and several tank barges moored at said facility.

The plaintiff seeks an order for the arrest of M/V William S and ATB Lucia/Caribbean, payment for losses sustained by plaintiff, plus interest and all further relief as the law and justice may grant. It is represented by Daniel G. McDermott of Marshall, Dennehey, Warner, Coleman & Goggin in New York and Christopher E. Carey and Frederick T. Haas III of Pugh, Accardo, Haas, Radecker & Carey LLC in New Orleans.
