Man claims New Orleans pharmacy disclosed personal information

NEW ORLEANS – A man is seeking damages for private information being shared by a pharmacist.

John Doe filed a lawsuit June 15 against Avita Drugs LLC, doing business as Avita Pharmacy; ABC Insurance Co.; and Shavayza Fortson in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff is seeking damages for an incident that took place June 16, 2016, at the Avita Pharmacy in New Orleans. The suit states that while the plaintiff was at the pharmacy, the pharmacist loudly announced that his insurance would only cover his HIV medication. This caused great emotional distress to the plaintiff because numerous people heard the announcement, the complaint states.

The defendant is accused of negligence, invasion of privacy and overall negligence.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Jeffrey P. Berniard of Berniard Law Firm LLC in New Orleans.

The case has been assigned to Division C Judge Sidney H. Cates IV.
