Jefferson Parish man claims he was injured when he tripped outside of Sears store

GRETNA – A Jefferson Parish man claims he was caused to trip and fall on rubbery material.

James Rabalais, husband of/and Jean Burks Rabalais filed a suit June 23 against Sears, Roebuck and Co. in the 24th Judicial District Court alleging negligence.

According to the claim, the plaintiff is seeking damages for an incident that took place Oct. 25, 2016, outside of a Sears store at 4400 Veterans Blvd., Metairie. The suits states that the plaintiff tripped over a piece of rubber that was protruding from concrete. The plaintiff claims he was injured from the fall.

The defendant is accused of negligence by failing to remove the obstacle, failing to warn of the danger and overall negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Kenneth W. Andrieu of Kenneth W. Andrieu & Associates in New Orleans.

The case has been assigned to Division H Judge Glenn B. Ansardi.
