NEW ORLEANS — A construction worker has filed a class-action lawsuit against his former Baton Rouge employer over allegations he is owed unpaid overtime wages.

Reyniery Ramirez, individually and on behalf of all others similarly situated, filed a complaint on June 20 in the U.S. District Court for the Eastern District of Louisiana against Cajun Industries LLC alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendant in New Orleans from June 2014 to June 2016 as a manual laborer. The plaintiff holds Cajun Industries LLC responsible because he often worked more than 40 hours a week but allegedly was not paid one-and-half times his hourly rate for all hours he worked off the clock.

The plaintiff requests a trial by jury and seeks an order certifying this case as a collective action, award for unpaid wages, interest, liquidated damages, attorneys’ fees and costs and all other general and equitable relief as the court deems equitable. He is represented by Roberto Luis Costales, William H. Beaumont and Emily A. Westermeier of Beaumont Costales LLC in New Orleans.
