LAKE CHARLES – A woman alleges she fractured four ribs as the result of a fall at a post office parking lot.

Cheryl A. Charpentier and Elfer Charpentier filed a complaint on June 28 in the U.S. District Court for the Western District of Louisiana, Lake Charles Division against United States of America alleging negligence.

According to the complaint, the plaintiffs allege that on Dec. 29, 2015, plaintiff Cheryl Charpentier was injured at the United States Post Office parking lot in Jennings in a fall because of a crack in the parking lot. She alleges that she sustained four fractured ribs, abrasions to her face and injuries to both knees. Her husband alleges he has suffered a loss of consortium.

The suit states she timely presented her claim on Standard Form 95 on Oct. 7, 2016, to the claims office of the USPS but that to date, no final decision has been reached. 

The plaintiffs hold United States of America responsible because the defendant allegedly failed to inspect/recognize/fix defective condition of the property and failed to warn user of the property of such condition.

The plaintiffs seek damages in an amount which is just and reasonable, plus legal interest, costs of these proceedings an all other just and equitable relief. They are represented by J. Neale deGravelles and Benjamin Treuting of deGravelles, Palmintier, Holthaus & Frugé LLP in Baton Rouge.
