Orleans Parish man claims he was injured when elevator fell

NEW ORLEANS – An Orleans Parish man claims he was injured when an elevator fell while he was in it.

David Benjamin filed a lawsuit against The Hartford Insurance Co., Executive Plaza LLC, Roxanne Moray and Westinghouse Electric Co. in Orleans Parish Civil District Court, alleging negligence.

According to the complaint, the plaintiff was in the elevator on July 5 at Executive Plaza's property when the incident occurred. The suit states the plaintiff was trying to take the elevator from the fifth floor to the fourth floor when it elevator dropped unexpectedly, causing the plaintiff to suffer injuries. It then dropped again to the second floor, causing additional injuries, the suit states. The plaintiff also claims he suffered emotional distress.

The defendant is accused of negligence by failing to keep up with maintenance on the elevator and failing to warn of danger, and overall negligence.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorneys Anthony D. Irpino, Lori A. Waters, Kacie F. Gray of Irpino, Avin & Hawkins in New Orleans.

The case has been assigned to Division D Judge Nakisha Ervin-Knott.
