BNSF Railway Company sues Dean Arlyn Goehring Jr. and Sparhawk Trucking Inc. for damages from a collision

In the United States District Court, Western District of Louisiana, BNSF Railway Company has filed a lawsuit against Dean Arlyn Goehring Jr. and Sparhawk Trucking Inc. The case, with ID 6:24-cv-00478-DCJ-CBW, was filed on April 9, 2024. The complaint alleges negligence leading to significant damages.

The plaintiff, BNSF Railway Company, a Delaware corporation with its principal place of business in Texas, accuses defendants Dean Arlyn Goehring Jr., an individual domiciled in Wisconsin, and Sparhawk Trucking Inc., a Wisconsin corporation, of causing an accident that resulted in substantial damage. On August 21, 2023, Goehring was operating a tractor-trailer owned by Sparhawk when it became lodged on a railway crossing owned by BNSF in Cade, Louisiana.

The lodged trailer caused a collision with an approaching BNSF train resulting in considerable damage. The court document states that the incident occurred despite the presence of warning signs and protective measures at the crossing.

BNSF Railway Company is seeking damages from both defendants jointly and severally for an amount exceeding seventy-five thousand dollars ($75,000), exclusive of interest and costs. The plaintiff alleges that the defendants' negligence and recklessness led to the accident and subsequent damages.
