Laborer suing after metal object allegedly falls on his head at worksite

GRETNA – A laborer is suing the contractors of a home he was working at after a piece of metal fell off the roof onto his head resulting in severe and disabling injuries.

Jacob Eduardo Melendez-Ramos, and wife Kenia Lizeth Quijada Montufar, filed suit against Garcia Roofing LLC, Garcia Sheet Metal LLC, Garcia Roofing & Sheet Metal Inc., Garcia management Group LLC, Roofcorp USA LLC, Associated Industries Insurance Company Inc., Amtrust North America Inc., Miller Custom Homes LLC and Miller Building Company LLC in the 24th Judicial District Court on May 7.

The defendants allegedly entered into a contract to build a new two story home with at least two chimneys that was being built at 202 Sycamore Drive in Metairie. The plaintiffs allege Miller Building subcontracted interior work on the home to Jason Bertoniere LLC which employed Melendez-Ramos.

Melendez-Ramos contends that on May 9, 2014 he reported to the construction site where the roof was being installed and that when he took a break around 9:15 a.m. he walked outside and a large metal object fell from the roof string him on the head, making him dazed and confused before rendering him unconscious. Melendez-Ramos asserts he was transported to the hospital and received severe injuries that have resulted in persistent debilitating conditions including headaches, neck pain, shoulder pain, radiating pain and mental and psychological deficits.

The defendant is accused of general negligence.

An unspecified amount in damages is sought for medical expenses, physical pain and suffering, mental anguish, permanent injury, disability, loss of enjoyment of life, lost wages, loss of earning capacity, diminution of earning capacity and impairment.

The plaintiffs are represented by Richard C. Ely Jr. of Metairie-based Mitchell Sanchez LLC.

The case has been assigned to Division O Judge Danyelle M. Taylor.
