A customer service agent for US Airways filed a civil rights violation complaint claiming she was fired after reporting her supervisor for allegedly posting a sexually inappropriate picture of her on Facebook.
According to Michelle Yancy's suit filed March 26 in New Orleans federal court, she was informed in May 2009 that a sexually inappropriate picture of her was on Facebook. The picture was located on a supervisor's page with comments from several other supervisors, her complaint states.
She claims she is the victim of racial discrimination, sexual harassment and retaliation for filing a complaint.
Yancy claims her employer violated Title VII of the Civil Rights Act, the Fair Labor Standards Act and Louisiana's Whistleblower Statute.
She filed charges of discrimination and retaliation with the Equal Employment Opportunity Commission and in return, received right to sue letters.
Her complaint seeks more than $75,000 in damages for emotional distress, physical injury and disability, medical treatment, lost income, lost employment opportunities and benefits, loss of earning capacity, interest, court costs and attorney's fees.
