The owner of property in Orleans Parish has filed suit against his insurance company, claiming the company failed to pay for Hurricane Katrina-related wind damage.

Carrie Price and Millie Selvage, and the succession of Carrie Price, filed suit against Encompass Property & Casualty Co. on April 27 in the Orleans Parish District Court.

The defendant is accused of not providing the "necessary layers of coverage" within the time constraints set out by the Louisiana Insurance Code for the plaintiffs' property located at 3325-3327 3rd Street in New Orleans.

Although they state their claim will not exceed $75,000, Price and Selvage are asking the court to award damages for property damage, loss of use of property, mold remediation, loss of contents, debris removal, penalties, interest, court costs, and attorney's fees.

New Orleans attorneys David W. Bernberg and Henna Ghafoor of the Law Office of David W. Bernberg are representing Price and Selvage.

Judge Herbert A. Case is assigned to the case.
