Customer sues Saks Fifth Avenue for not refunding jewelry purchase

A customer is suing Saks Fifth Avenue for refusing to refund her money.

Bridgette Green filed suit against Saks Fifth Avenue April 16 in Jefferson Parish District Court. Saks removed the case on June 2 to federal court in New Orleans.

Green says that in April 2009 she ordered several pieces of jewelry from the department store and billed the purchases to her credit account. When the jewelry arrived in the mail, Green decided she did not like it and returned the merchandise. She claims she was told her that her account would be credited for the purchase amount. Green says she learned the credit had not been issued when she was contacted by a credit protection service notifying her of a late payment on her credit report.

Green says she contacted Saks Fifth Avenue and was told she could not receive a refund because the jewelry was damaged. Green says she went to the store to inspect the jewelry but saw no damage. The company allegedly refused to allow Green to return the jewelry.

According to the court records, Saks continued to bill Green for the merchandise. Green says, as a result, she suffered a damaged credit score and harm to her personal and business reputation and credit rating.

The plaintiff accuses Saks Fifth Avenue of breach of contract, violations of the Fair Debt Collection Practices Act and other acts of gross negligence.

Green is seeking damages for mental anguish, damage to her credit, loss of earning capacity, loss of income, interest and court costs.

New Orleans attorneys Clifton Davis, III and Ernestine Anderson-Trahan of the Law Offices of Trahan & Davis are representing Green.

U.S. District Judge Helen G. Berrigan is assigned to the case.
