Seaman wants $1 million after falling off of vessel

A seaman is suing the owner of a vessel, claiming he slipped and fell on the ship.

Arguing the vessel was unseaworthy due to lack of slip and fall warnings, Henry Ebanks filed suit against Reel Pipe on June 3 in federal court in New Orleans.

The alleged incident happened Nov. 7, 2009 when Ebanks was working as an engine room oiler on the M/V Joshua Chouest. The vessel was docked when Ebanks says he slipped in an accumulation of oil and other substances and fell off the vessel. Ebanks says the fall injured his back and neck.

Ebanks is seeking more than $1.25 million in damages for medical expenses, maintenance and cure, physical and mental pain and suffering, permanent physical scaring and disability, loss of wage earning capacity, attorney's fees, court costs and interest.

New Orleans attorney Paul M. Sterbcow of Lewis, Kullman, Sterbcow & Abramson is representing Banks.

U.S. District Judge Jay C. Zainey is assigned to the case.
