An employee of the Board of Commissioners of the Port of New Orleans has filed suit against a construction company after stepping into a fence post hole and injuring herself.
Doris Palmer filed suit against Hamp's Construction and The Gray Insurance Co. July 15 in Orleans Parish District Court.
Palmers states she was in the process of picking up trash adjacent to a new fence on the Board of Commissioner's property. While walking, she claims she stepped into a circular hole that was concealed by weeds.
According to the lawsuit, the Board of Commissioners and the defendants had a contract in which the defendant was required to fill holes created by the removal of existing fence posts while constructing the new fence.
Hamp's Construction is accused of breaching its duty under the contract and negligence for failing to fill the holes.
Palmer is seeking damages for medical expenses, lost wages, loss of earning capacity, mental and physical pain and suffering, permanent injury, loss of life's pleasures, interest and court costs.
Judge Kern A. Reese is assigned to the case.
