A Houma resident has filed a lawsuit over personal injuries he received when two vessels collided.
Jacob Luke filed suit against Nautical Ventures July 27 in federal court in New Orleans.
The collision occurred in March 2009 in Fresh Water Bayou, Louisiana. Luke states he was working as a deckhand on the Lil' Man vessel when it collided into another vessel, the C-Atlas.
Luke claims he injured his neck, back, shoulder and right side due to the unseaworthiness of the vessel.
The defendant is accused of negligence for failing to keep a proper lookout by sight and hearing to ensure the other vessel was fully clear, failing to proceed at a safe speed, failing to avoid a collision, failing to take proper evasive actions and failing to hold course while being passed by another vessel.
Luke is seeking damages for medical expenses, physical pain and suffering, mental anguish, physical impairment, physical disfigurement, lost earnings, loss of earning capacity, punitive damages, interest, court costs and attorney's fees.
Luke is represented by Steven J. Gordon of Gordon, Elias & Seely in Houston. A jury trial is requested.
U.S. District Judge Lance M. Africk is assigned to the case.
