A cook has filed a lawsuit against his employer after he tripped and fell when walking out of a cooler.

Wayne David Charles Marshall filed suit against Supreme Offshore Services Inc. on Sept. 20 in federal court in New Orleans.

The accident occurred on Aug. 7, as Marshall was working as a cook aboard the M/V Bertha D, a vessel owned and operated by the defendant.

The defendant is accused of negligence for failing to provide a safe place to work, failing to warn of the dangerous and unsafe conditions, failing to properly maintain and repair the vessel and breach of legally imposed duties of reasonable care owed by the defendants to Marshall.

Marshall is seeking damages for medical expenses, physical pain, mental anguish, disability, attorney's fees, interest and court costs.

He is represented by Lawrence Blake Jones, David C. Whitmore and Julie Sumrall of Scheuermann & Jones in New Orleans.

U.S. District Judge Sarah S. Vance is assigned to the case.
