Winn-Dixie sued by shopper over slip and fall incident

Winn-Dixie shopper Shalonda Davis filed suit after a slip and fall injury allegedly required her to undergo hip surgery.

Davis sued on Dec. 17, 2009 in St. Bernard Parish District Court. The case was removed to federal court in New Orleans on Sept. 28.

The slip and fall incident occurred on Dec. 3, 2008 as Davis was shopping at Winn-Dixie located in Chalmette. She claims she suddenly and without warning slipped and fell on a foreign substance that was on the floor. She claims she injured her back and neck and has since undergone surgery on her hip due to the accident.

The defendant is accused of negligence for failing to provide proper maintenance and keeping their premises in safe condition, failing to make timely inspections, failing to properly train and/or supervise their employees, failing to remedy an unsafe or hazardous condition, allowing a dangerous condition to exist, allowing an unstable display shelf and failing to have restrains and edges on the display shelf.

Davis is seeking damages for pain and suffering, medical expenses, permanent disability, interest and court costs.

She is represented by Jeanne K. Demarest of Alvendia, Kelly & Demarest in New Orleans.

U.S. District Judge Ivan L. R. Lemelle is assigned to the case.
