A man is suing Wal-Mart for injuries his wife allegedly suffered when she slipped on smashed grapes in a store aisle.

Sullivan Francis filed the lawsuit against Wal-Mart Louisiana LLC Oct. 19 in Orleans Parish District Court.

Sullivan claims his wife, Sharon, was hurt while shopping in the Wal-Mart on Behrman Place in New Orleans in October 2009. Sullivan says his wife was walking near the store's vision center when she slipped on a slippery substance and fell. Sullivan believes smashed grapes are what caused Sharon to slip.

Sullivan says his wife suffered serious and disabling injuries in the fall and is now no longer able to provide him companionship.

Sullivan accuses Wal-Mart Louisiana of negligence, saying employees knew there was a slippery substance on the floor but failed to remove it, keep customers from walking on it or warning shoppers of the danger.

Sullivan is asking for unspecified damages for a loss of consortium and society with his wife.

Attorney William R. Mustian III of Stanga & Mustian LLC in Metairie is representing is representing Francis.
