A New Orleans company is accusing its former attorney and his law firm of providing poor legal representation.
SJD-CC LLC filed a lawsuit against Steven B. Loeb and the law firm Breazeale, Sachese & Wilson LLP Oct. 21 in Orleans Parish District Court.
SJD-CC says it hired Loeb in October 2009 to represent the company during what it describes as "Travelers Litigation." The original purpose of the litigation was to recover insurance money from Travelers Indemnity Company of Connecticut for property damage sustained by SJD-CC as a result of Hurricane Katrina.
During the Travelers Litigation, SJD-CC says it had to prove the business was insured by Travelers under an "all risk" policy – which SJD-CC argues was in place at the time of the hurricane damage. However, during his instructions to the jury in December 2009, SJD-CC contends the judge mistakenly called it a "named peril policy" and Loeb failed to object to the error.
SJD-CC lost the case and alleges Loeb's failure to object to the judge's error is the reason.
SJD is suing Loeb and Breazeale, Sachese & Wilson for negligence and asks for an unspecified amount of money for damages and court costs.
SJD-CC is represented by attorney Regel L. Bisso of Metairie. They have requested a jury trial.
