Family blames Michelin for fatal accident

The family of a deceased Louisiana woman has filed a lawsuit against Michelin North America claiming a tire unexpectedly failed causing a fatal accident.

Willie Mae Person as Tutrix of Joshua Tashan and Coty A. Hally, individually and on behalf of Leshell Denise Hally, deceased, filed the suit on Jan. 3 in federal court in New Orleans.

The accident occurred on Jan. 12, 2010 as Leshell Denise Hally was driving a 2004 Ford Mercury Mountaineer on I-12 west bound in Tangipahoa Parish.

After the tire failed, Hally lost control of the vehicle and it entered a rollover sequence, the suit claims.

The defendant is accused of strict liability and negligence.

Person claims the tire was unreasonably dangerous in its construction and composition, design and because of inadequate warnings.

The plaintiff is seeking survival and wrongful death damages for pain and suffering, mental anguish and emotional distress, loss of love, affection, companionship and society, grief, loss of support and services, funeral and burial expenses, interest and court costs.

Person is represented by Christopher Batman of Batman Law Firm in Corpus Christi.

U.S. District Judge A. J. McNamara is assigned to the case.
