Lee Trevino sues for $2 million claiming vessel's unseaworthiness caused injury

A seaman aboard a tugboat is suing his employer for more than $2 million claiming the vessel's unseaworthiness caused him to suffer an injury.

Lee Trevino filed suit against D & S Marine Service on Feb. 22 in federal court in New Orleans.

According to the lawsuit, Trevino was employed by the defendant as a seaman and worked as a tanker man aboard a tugboat. Trevino states he was seriously and permanently injured on Oct. 24, 2009 while in the course and scope of his employment.

He argues his injury is the result of the negligence of the defendant and due to the unseaworthiness of the vessel.

The plaintiff is asking for more than $2 million in damages for lost wages, loss of earning capacity, medical expenses, physical pain and suffering, mental anguish, emotional distress, disfigurement, disability, loss of the ability to enjoy life's pleasures and court costs. Trevino is also asking for an award of past and future maintenance and cure.

Trevino is represented by Scott E. Silbert of Silbert & Garon in New Orleans.

U.S. District Judge Eldon E. Fallon is assigned to the case.
