A Jefferson Parish woman is suing the Ochsner Baptist Medical Center and DePuy Orthopaedics claiming damages after she received an allegedly defective DePuy hip replacement.
Kenner attorney Stephen Rue filed the petition for damages on behalf of Norma Scales on May 27 in Orleans Parish Civil District Court.
The suit claims the plaintiff received a DePuy ASR hip replacement from an Oschner doctor at a New Orleans medical center in 2009.
The suit claims the ASR "was inherently dangerous for its intended use" due to several reasons including inadequate and defective design and failing to perform its intended function.
The suit claims the ASR "was defective as defined by Louisiana Produces[sic] Liability Act."
DePuy ASR distributor Mark Starring & Associates is also named as a defendant in the suit.
The plaintiff claims Starring "were aware of the dangers regarding the ASR Hip ... but failed to convey this information to the public including Plaintiff."
The suit claims Starring "breached its duties" and acted "intentionally, negligently and carelessly" in its distribution of the defective product.
As a result of being given the faulty implant, the plaintiff had to pay extensive medical bills for "revision surgery" and suffered lost income and attorneys fees.
This case has been assigned to Orleans Parish Judge Michael Bagneris has been assigned this case.
