Downman Supermarket claims vibrations from construction site caused damage to store

A New Orleans supermarket is suing Hill Brothers Construction, claiming "excessive vibrations" form a worksite caused the store to "sustain irreparable structural damages."

New Orleans attorneys Anthony Irpino, Adam Avin and Louise Higgins filed the petition for damages on behalf of Fadi Inc., which does business as Downman Supermarket.

The suit was filed June 6 in Orleans Parish Civil District Court.

The suit claims that while Hill Brothers was operating on a property down the street from Downman when damage to its walls, floors and adjacent parking lot occurred.

The suit claims the construction is ongoing and Hill Brothers "placed barriers on and around the plaintiff's business thereby denying easy egress and regress to the property."

Hill Brothers is accused of negligence and failing to exercise reasonable care, among other charges, the suit claims.

Property damage, diminished value of the property and a "[s]evere decrease in revenue" are listed among the Supermarket's damages.

Orleans Parish Judge Piper Griffin was assigned this case.
