Pizza chef sues for unpaid overtime wages

A pizza chef at a Louisiana restaurant and bar has filed a lawsuit against the company in an effort to obtain unpaid overtime wages.

Claiming violations of the Fair Labor Standards Act, Mitchell Stinnett filed suit against Sunrise Entertainment Inc. on July 13 in federal court in New Orleans.

Stinnett was hired as a cook by the defendant in May 2010. According to the lawsuit, the defendant would pay Stinnett for all hours worked in excess of 40 hours in a single work week at the regular rate and in cash. "This method of paying overtime hours was perpetrated for the sole purpose of Defendant intentionally obscuring from government authorities and his employees his obligations and liabilities to pay overtime pursuant to the FLSA," the lawsuit states.

The defendant is accused of violating the FLSA willfully and with reckless disregard of
clearly applicable provisions.

The plaintiff is asking for an award of overtime compensation in the amount due him, front pay liquidated damages, attorney's fees, court costs and interest.

Stinnett is represented by New Orleans attorney Jody Forester Jackson. A jury trial is requested.

U.S. District Judge Eldon E. Fallon is assigned to the case.
