Gas station sued after woman slips getting into truck

An Amite gas station is being sued by a woman who claims she stepped in a foreign substance on the ground that caused her to slip and fall while trying to get into her truck.

Betty Kimmons originally filed suit against Racetrac Petroleum Inc. and Broadspire Services Inc. on April 6 in Tangipahoa Parish District Court. The defendants removed the case to federal court in New Orleans.

The alleged incident occurred on April 10, 2010 as Kimmons was pumping gasoline into her truck.

The defendants are accused of negligence for failing to maintain a safe environment, creating an unreasonably dangerous condition on the ground in front of the pump, failing to exercise reasonable care and diligence in the discovery of the liquid/foreign substance on the ground, failing to provide adequate safety or clean-up measures to prevent accidents, failing to warn Kimmons of unreasonably dangerous conditions and failing to implement adequate safety measures.

The plaintiff is seeking damages for injuries, mental pain and suffering, loss of enjoyment of life, medical expenses, lost wages, loss of earning capacity, aggravation and inconvenience, interest and court costs.

Kimmons is represented by Baton Rouge attorney Kris A. Perrett.

U.S. District Judge Mary Vial Lemmon is assigned to the case.
