Seaman sues after injuring neck while moving vessel's walkway

NEW ORLEANS - A seaman has filed a lawsuit against his employer after he suffered neck injuries while moving a vessel's walkway.

George B. Creamer filed suit against Allied Marine Services on Jan. 10 in federal court in New Orleans.

The alleged incident occurred on May 17, 2009 while Creamer was assigned as a crewmember to the M/V Allied Elevator No. 1. The vessel was jacked up next to the dock and Creamer was manually moving an aluminum walkway/gangway to be placed across the vessel to the shore. While he was in the process of moving the walkway, Creamer sustained serious and disabling injuries to his neck, he claims.

The defendant is accused of negligence for failing to follow necessary safety precautions in the operation and employment of its equipment, personnel and vessels, failing to carefully inspect vessel and its deck for deficiencies, failing to provide a safe place to work, failing to follow necessary safety precautions, failing to properly train, supervise and inform personnel of the known hazards or risks associated with the operations being conducted, and for failing to secure and supply equipment, personnel and vessels.

Allied Marine is also accused of failing to carefully inspect the equipment for deficiencies, failing to device and implement an operational plan which sufficiently considered personnel safety issues, and for failing to comply with company safety rules, industry safety standards, and governmental safety rules.

The plaintiff is seeking damages for medical expenses, loss of income and benefits, loss of earning capacity, loss of insurability, physical pain and suffering, mental and emotional anguish and distress, disfigurement, loss of enjoyment of life, maintenance and cure, court costs, interest, and expert fees.

Creamer is represented by Houma attorney Patrick H. Yancey.

U.S. District Judge Jane Triche Milazzo is assigned to the case.
