GRETNA – A Jefferson Parish dialysis clinic is suing the Jefferson Parish Sheriff's Office in its official role as the parish tax collector for overcharges in sales tax.

Renal Life Link filed suit on Feb. 17 in 24th Judicial District Court against Jefferson parish Sheriff Newell D. Normand and the Jefferson Parish Bureau of Revenue.

Renal Life Link, a subsidiary of nationwide dialysis provider DaVita, claims it paid sales tax midway through 2011 and lodged their intent to protest a portion of those taxes. The plaintiff asked the defendant to leave the contested portion of the taxes in escrow until the matter could be dealt with. The plaintiff asserts that Jefferson Parish should not be charging sales tax under the provisions of Medicare on some prescription drugs for end-stage renal disease.

Damages are sought in the amount of $640.86 for taxes paid under protest.

Renal Life Link is being represented by Matthew A. Mantle of New Orleans-based Jones Walker.

The case has been assigned to Division O Judge Ross P. LaDart.
