Home insurer sues company for alleged damages from faulty home elevation

NEW ORLEANS – A Louisiana-based insurer is suing a home lifting contractor for damages allegedly attributed to a botched home elevation.

Louisiana Citizens Property Insurance Corporation filed suit on Feb. 17 in Orleans Parish Civil District Court against LAA Shoring, LLC, Luis Acosta and their insurers.

The plaintiff claims the defendants damaged the home of Ronald and Antoinette Johnston at 4648 Shalimar Dr. in New Orleans where they were contracted to elevate the home.

The defendants are alleged to have made the home temporarily uninhabitable due to the work the completed. The plaintiff claims the defendants should be liable for damages the Johnstons paid in insurance claims.

The defendants are also accused of not taking proper precautions to avoid property damage, operating vehicles in an unsafe manner, not using reasonable diligence, not keeping proper lookout and failing to provide a reasonable standard of care on the work site.

Damages sought include the amount to correct the damage plus attorney's fees and legal costs.

The plaintiff is being represented by Christopher M. McNabb of New Orleans-based firm Fontana and Steelman.

The case has been assigned to Division M Judge Paulette R. Irons.
