NEW ORLEANS – A Jefferson Parish attorney is suing a local sushi restaurant for a loan he claims it defaulted on.

Benjamin J. Birdsall, Jr. filed suit on Feb. 9 in Orleans Parish Civil District Court against George D. Nelson, III and Rock-N-Sake. Birdsall claims he loaned the restaurant $44,000 in April of 2006 that should have been paid back through revenues on video poker machines owned by Poydras Gaming, LLC.

The plaintiff claims only $8,713.26 was paid on the loan and that the machines were removed from the premises at 823 Fulton Street in New Orleans. The defendants are accused of breaching the loan contract.

Damages in the amount of $35,286.74 are sought by the plaintiff.

Birdsall is being represented by Stephen F. Harris, Jr. of the Birdsall Law Firm.

The case has been assigned to Division F Judge Christopher J. Bruno.
