Bellaire Drive residents file joint suit against Corps of Engineers contractor

NEW ORLEANS – A group of New Orleans neighbors have filed suit against a government contractor who is doing construction work in their neighborhood.

Tammy and Roy Arrigo, Cindy and Craig Berthold, Nida and Terry Lonatro and Amy and George Sins filed suit on March 8 against Charles E. Bailey, CKY Inc. and their insurers in Orleans Parish Civil District Court.

The plaintiffs claim the defendants were authorized by the Department of Army, Corps of Engineers to construct the Hurricane and Storm Damage Risk Reduction System nearby their homes. The plaintiffs allege severe vibrations from the construction site damaged their homes. The defendants are accused of failing to investigate the effect the construction would have on adjacent properties, failing to implement safeguards against damaging other properties, failing to use proper worksmanship, failing to use best possible equipment and materials in the project, failing to take action to reduce vibrations and failing to monitor vibrations from construction site.

An unspecified amount in damages is sought for each property.

The plaintiffs are being represented by Deborah A. Villio of Metairie-based Leblance Butler, LLC.

The case has been assigned to Division A Judge Tiffany G. Chase.
