NEW ORLEANS - LaFourche Parish residents have filed a personal injury lawsuit against a Florida restaurant after a woman slips and injuries her knee.
Lynnette G. Hartman and Michael Hartman filed suit against Ignite Restaurant Group Inc. and CDR Destin Landry's on March 8, 2012 in LaFourche Parish District Court. The defendants removed the case to federal court in New Orleans on May 14.
The incident occurred on March 11, 2011 while Lynnette Hartman was visiting the Joe's Crab Shack in Destin, Fla. She states that after she finished her meal and exited a booth, she slipped in a foreign liquid on the floor and landed on her left knee.
Hartman states that immediately following the incident that the manager on duty determined that the floor coverings were not in proper position immediately adjacent to the booth.
The defendants are accused of failing to maintain the premises in a safe condition and for failing to provide notice to the restaurant's invitees of the existence of an unsafe condition.
The plaintiffs are seeking damages for medical expenses, disability, loss of consortium, loss of love and affection, and pain and suffering.
The Hartmans are represented by Phil C. Nugent of Phil C. Nugent & Associates in New Orleans.
U.S. District Judge Carl J. Barbier is assigned to the case.
