Carwash operator suing carwash machine manufacturer

NEW ORLEANS – The operator of five local car washes is suing a manufacturer of a car wash machine.

Clothesline Laundromat, Inc. filed suit against Pesco, Inc. and Sonny's Enterprises, Inc. in the New Orleans Civil District Court on May 31.

Clothesline claims it bought two automatic car wash machines from Pesco that were manufactured by Sonny's. The plaintiff alleges that both of the machines sold to them were defective and left scratches on customers' cars. The plaintiff also asserts that the defendants lied to them about the machines saying they were newer models than those used in a demonstration, however, the machines appear to be the same.

The defendants are accused of breach of contract, breach of actual or implied warranty, redhibition, negligent or intentional misrepresentation, unfair trade practice, reasonable reliance and unjust enrichment.

An unspecified amount in damages is sought for all cost and attorney's fees.

Clothesline is represented by Covington-based attorney Rusty Savoie.

The case has been assigned to Division H Judge Michael G. Bagneris.

Case number 2012-05418.
