Mother claims child's birth defects caused by Zoloft

NEW ORLEANS - A Jefferson Parish mom has filed a lawsuit that claims her son's birth defects were the result of her using the antidepressant Zoloft during pregnancy.

Lasikha Robertson Asphall, individually and on behalf of her eight year old minor son, filed suit against Pfizer Inc. on June 1 in federal court in New Orleans.

Asphall states that her son's development delays and birth defects are the result of her ingesting Zoloft during her pregnancy. The child was born with heart defects, the suit says.

Pfizer is accused of wrongful conduct in the design, development, manufacture, distribution, labeling, advertising, marketing, promotion and selling of the drug.

Causes of action filed against Pfizer include construction or composition defect, design defect, inadequate warning, breach of express warranty, and redhibition.

The plaintiff is asking the court for an award of actual damages, including damages for medical monitoring, interest, attorney's fees and court costs.

Asphall is represented by Michael Hingle, Bryan A. Pfleeger, and Ronald J. Favre of Michael Hingle & Associates in Slidell. A jury trial is requested.

U.S. District Judge Helen G. Berrigan is assigned to the case.
