Chiropractor sues website company claiming name is being misused

GRETNA – A Gretna chiropractor is suing a website company for not taking down a website bearing his name.

Dr. Tony Giang filed suit against Evolocity, Inc. in the 24th Judicial District Court on July 9. Giang claims he contracted Evolocity to provide a website for him, but later when he chose not to have the defendant maintain the website, the company refused to remove it.

The plaintiff also alleges that calls made to the number on the website are not being forwarded to his office and the defendant is allegedly withholding the calls and asking the plaintiff for a subsciprtion fee to receive them.

The defendant is accused of negligence, violating state law, using the plaintiff's name without his consent, derogation of plaintiff's possessory right, wrongful exercise of assumption of another's goods and depriving the plaintiff of possession for an indefinite period of time.

The plaintiff is seeking to have a permanent injunction granted disallowing Evolocity from using his name and forcing the company to remove any websites that would solicit patients under his name.

Giang is represented by New Orleans-based attorney Timothy R. Richardson.

The case has been assigned to Division E Judge John J. Molaison, Jr.
