Hospital sued for allegedly losing biopsy sample

NEW ORLEANS – A New Orleans woman has filed suit against a local hospital for losing her biopsy sample, which required another biopsy.

Barbara Philips filed suit against Ochsner Clinic in the Orleans Parish Civil District Court on July 6.

Philips claims she reported to Ochsner in September 2011 with a thyroid problem. The plaintiff alleges that she had part of her thyroid removed to find out if it was cancerous and the sample was mishandled and lost by the clinic. Philips asserts she had to undergo another medical procedure to make up for the lost specimen.

The defendant is accused of failing to adequately retain specimen in safe keeping, negligent supervision of patient specimen, failing to ensure the safety of its patients and failing to insure the well-being of its patient.

An unspecified amount in damages is sought for emotional distress, loss of service and society, mental anguish, pain and suffering and inconvenience.

Philips is represented by Robert B. Evans of New Orleans-based Burgos & Evans, LLC.

The case has been assigned to Division D Judge Lloyd J. Medley.
