Shoring company sued by former salesman who claims emotional anguish over commission

GRETNA – A St. Tammany Parish man is suing a Jefferson Parish shoring company for allegedly withholding sales commission he was to receive.

Anton Raterman filed suit against Southern Elevations and Shoring, Inc. in the 24th Judicial District Court on July 27.

Raterman claims he was hired by Southern Shoring in June 2011 to obtain business for shoring and elevation work that was to be funded by grants. The plaintiff claims over the next two months he obtained signed contracts with clients in anticipation of them receiving grant funding to have their homes lifted. Raterman asserts that he was supposed to receive five percent commission for each contract, but he never received a commission check after being discharged from the position in August 2011. Raterman alleges that he was never given a breakdown of how many of the contracts received payment nor was he paid within 15 days of being terminated from the position as it should have been under state law.

The defendant is accused of fraud in avoiding to pay commissions owed on contracts, fraud in converting the sales commission to their own use and not paying the plaintiff, fraud in paying commission to other employees that was owed to the plaintiff, and violation of civil code and state law.

An unspecified amount in damages is sought for severe emotional injuries, medical costs, legal interests and attorney's fees.

The case has been assigned to Division G Judge Robert A. Pitre, Jr.
