Used car dealer sue over selling allegedly defective car

GRETNA – A New Orleans woman is suing a Westwego-based used car dealer for allegedly selling her a defective vehicle.

Kendra Battley filed suit against Wego Auto Sales, Inc. in the 24th Judicial District Court on July 31.

Battley claims she bought a used 2006 Chevrolet HRH for $12,190.25 with $2,500 paid in cash and $355.18 charged per month thereafter from Wego Auto Sales located at 200 Westbank Expressway in Westwego. She alleges she purchase an extended warranty with the vehicle and that shortly after she took possession of it the vehicle would not start.

The defendant towed the vehicle back to its lot where it determined there were no problems with it. Upon receiving the vehicle again, Battley claims it still would not start.

The plaintiff claims she had the vehicle evaluated by two automobile mechanics who said the vehicle's engine was defective and needed to be replaced. Battley asserts she asked Wego Auto Sales to remedy the situation, but it did not comply.

The defendant is accused of being aware of the vehicle's defects at the time of sale and failing to disclose it to the plaintiff.

An unspecified amount in damages is sought for the return of the purchase price, insurance co-payments, insurance premiums, interest on the amounts from the date of purchase, mechanic costs, storage costs, attorney's fees and costs and equitable relief.

Battley is represented by Douglas P. Matthews of New Orleans-based King, Krebs & Jurgens, LLP.

The case has been assigned to Division A Judge Raymond S. Steib.
