Man sues Days Inn for allegedly being exposed to toxic mold

GRETNA – A Missouri man has sued a local hotel that is part of national chain for allegedly being exposed to toxic mold.

James P. Whittaker filed suit against Days Inn also known as Days Hotel New Orleans-Metairie in the 24th Judicial District Court on July 31.

Whittaker claims he was a patron at the Days Inn located at 3400 S. I-10 Service Road in Metairie when he was exposed to toxic mold. The plaintiff alleges that he suffered chronic respiratory injuries and other injuries from the exposure.

The defendant is accused of failing to properly clean or otherwise care for its property to prevent the mold from forming as well as not preventing guests from being exposed to the mold.

An unspecified amount in damages is sought for physical pain and suffering, fear, mental anguish, distress, loss of past and future earnings and medical expenses.

Whittaker is represented by Daryl J. Daigle of New Orleans-based Taylor, Wellons, Politz & Duhe, APLC.

The case has been assigned to Division E Judge John J. Molaison, Jr.
