Oil companies sued by family of deceased pipe cleaner for wrongful death

GRETNA – A family is suing multiple companies over the death of former pill production pipe cleaner.

Eula K. Pierce and Brandy K. Pierce filed suit against Exxon Mobil Corporation, Exxon Mobil Oil Corporation, Humble, Inc., Chevron USA, Marathon Oil Company, Placid Oil Company, Shell Oil Company, Shell Oil Offshore Inc., Swepi LP and Conoco Philips Company in the 24th Judicial District Court on Aug. 3. The Pierces claim their husband and father Warren Pierce died due to exposure to hazardous materials including radiation, hazardous and toxic pipe cleaning materials. The plaintiffs claim Warren was a pipe professional cleaner who cleaned toxic buildup out of pipes owned by the defendants.

The defendants are accused of knowing the danger of hazardous materials in the pipes, knowing the deceased would be exposed to toxins, failing to inform workers of the hazard, violating the cleaning contract by not divulging the hazard, failing to test for the toxins, failing to properly dispose of the hazardous waste, failing to mark contaminated pipe, acting in a careless and negligent manner and engaging in an ultra-hazardous activity.

An unspecified amount in damages is sought for wrongful death, pre-death pain and suffering, loss of income, medical expenses and loss of decendent's love.

The Pierces are represented by Jeremiah A. Sprague of the Lapalco-based Falcon Law Firm.

The case has been assigned to Division B Judge Cornelius E. Regan.
