NEW ORLEANS – A Pointe Coupee Parish woman is suing Amtrak claiming she was injured as a result of employee negligence.

Patricia Dibenedetto filed a lawsuit against National Passenger Railroad Corporation, commonly known as Amtrak, in the Orleans Parish Central District court on July 25. Dibenedetto claims that she was injured due to an Amtrak porter failing to return the stepping stool used to help passengers mount the train. Plaintiff alleges she suffered permanent injury of her lumbar, thoracic spine and left knee.

The defendant is accused of failure to provide proper and safe means of boarding and exit, failure to supervise, failure to warn, and breach of duty of reasonable care.

An unspecified amount is sought for all damages including, but not exclusively, physical pain and suffering, medical expenses, and public humiliation.

The plaintiff is represented by Richard G. Whitworth of Baton Rouge-based Whitworth Law Firm LLC.

The case has been assigned to Division F Judge Christopher J. Bruno.
