GRETNA – A tow truck driver who was allegedly drinking on the job and the company he was working for are being sued by a couple after he allegedly rear-ended their vehicle.

Edward and Amanda Mitchell filed suit against John Richard Young, Dale's Towing & Storage and Houston Insurance Specialty Compnay in the 24th Judicial District Court on Aug. 10.

The Mitchells claim they were traveling south on LA 23 in Jefferson Parish when they stopped at a red light and a tow truck owned by Dale's Towing and driven by Young ran into their vehicle from behind. The plaintiffs allege Young was intoxicated at the time of the accident.

The Mitchells assert they both suffered serious bodily injuries in the accident.

The defendant is accused of failing to maintain reasonable vigilance, failing to see what should have been seen, operating a motor vehicle in a careless and reckless manner, negligent injuring, failing to stop vehicle to avoid the accident, driving in an inattentive and distracted manner, running into the rear of another vehicle, driving under the influence and being an unskilled and irresponsible vehicle operator.

An unspecified amount in damages is sought for pain and suffering, mental anguish, loss of earnings and medical expenses.

The case has been assigned to Division G Judge Robert A. Pitre, Jr.
