NEW ORLEANS - A shopper is suing a Slidell store claiming the store failed to maintain its premises causing her to trip and fall over plastic wrapping from a firewood display.
Sandra Villere and Jules Corwin filed suit against Winn-Dixie Montgomery on Sept. 17 in federal court in New Orleans.
The alleged incident occurred on Dec. 7, 2011 as Villere was walking along the sidewalk of the store and plastic wrap from the firewood display wrapped around her foot, causing her to trip and fall.
The defendant is accused of negligence for failing to maintain the premises, failing to inspect the premises, failing to provide a safe place to shop, failing to set up an adequate inspection and maintenance schedule of the premises, and for failing to warn of the dangerous situation which could cause bodily harm.
Villere and Corwin are seeking damages for pain and suffering, medical expenses, loss of enjoyment of life, humiliation, embarrassment, inconvenience, loss of consortium, mental anguish, lost wages, loss of earning capacity, loss of consortium, service, and society, court costs, and interest.
The plaintiffs are represented by Jim S. Hall and Joseph W. Rausch of Jim S. Hall & Associates in Metairie.
U.S. District Judge Ivan L. R. Lemelle is assigned to the case.
