GRETNA – The Jefferson Parish District Attorney's office is being sued by a woman who claims the office owes her a bond payment she made seven years ago for her now deceased ex-husband.
Susan B. Hammer filed suit against the District Attorney for the Parish of Jefferson on behalf of the State of Louisiana in the 24th Judicial District Court on Aug. 17. Hammer claims she made a bond payment to release her now deceased ex-husband from jail. The plaintiff alleges that the bond was forfeited when the deceased did not show up for a court hearing on July 22, 2005.
The plaintiff seeks to nullify, vacate and set aside the bond forfeiture because the Clerk of Court did not mail notice of the forfeiture within 60 days of the court hearing, which under state law should have released the plaintiff from any obligation.
Hammer is represented by New Orleans-based attorney Robert H. Garvey, Sr.
The case has been assigned to Division P Judge Lee V. Faulkner.
