BATON ROUGE – A Baton Rouge woman has filed suit against a discount retailer after she allegedly was injured on its premises.

Lisa Smith filed suit against Dollar Tree Stores, Inc. in the 19th Judicial Court on Aug.14.

The plaintiff was a customer at the Dollar Tree located at 2170 O'Neal Lane in Baton Rouge when an entire shelving assembly allegedly fell on her. Smith claims she was attempting to remove an item from a shelf when the unit fell, causing injuries to her neck, back and other parts of her body.

The defendant is accused of breaching a legally imposed duty of reasonable care, failing to properly inspect its displays, shelving and merchandise to ensure all were in safe condition, failing to warn plaintiff, failing to assemble shelving properly and failing to implement protocols for store employees to follow in the design, assembly, construction, maintenance and inspection of its shelves.

An unspecified amount in damages is sought for medical expenses, pain and suffering, metal anguish, emotional distress, loss of enjoyment of life and physical pain and suffering.

The plaintiff is represented by Phillip Bohrer of Bohrer Law Firm, LLC.

The case has been assigned to Division A Judge Hernandez.
