NEW ORLEANS - A New Orleans-based company is suing a general contractor, sub-contractor and other related entities for failure to submit payment in full for the use of equipment supplied in two major construction projects.
Equipco L.L.C filed a lawsuit against The Ionadi Company, Patrick Ionadi, Westchester Fire Insurance Company, and Satterfield &Pontikes Construction Group, L.L.C. in the Orleans Parish Central District Court on Aug. 7.
Equipco claims that after supplying equipment to defendants for a New Orleans and Braithwaite construction project they failed to pay in full the amount owed plaintiffs for their services. The plaintiff alleges that after amicable demand they still have not been rendered the payment and the defendants are in violation of the Louisiana Prompt Pay Act.
The defendant is accused of failure to pay Equipco the full value for the equipment provided for the New Phoenix and Crocker Projects.
The plaintiffs are seeking entitlement to recovery of penalties and attorney's fees under the prompt pay statute and compensation for all damages and losses including, but not limited to, all unpaid invoices and all other damages deemed reasonable in the premises.
